Michael Sieben represented the family of a 14-year old girl was was killed in a motor vehicle accident while a passenger in a van transporting her home from school. Decedent was an excellent student in the Forest Lake School District. Because she was nearly deaf, the district could no longer provide her with complete educational services. For the 2006-07 school year she was transported from her home to Highland Park for more intense education geared toward her disability. The transportation was provided by a local transportation company. The company performed a background check on the driver, but it proved to be incomplete. In addition, there were no requirements that the driver obtain a special license or submit to regular drug testing. The accident occured when the driver, traveling at highway speeds, rearended a school bus which was stopped. The van driver tested positive for marijuana. The drug was also found in the van and the driver’s lunchbox.
After intense negotiation, the insurer for the van offered its policy limits of $1,000,000. Michael Sieben was also instrumental, in cooperation with the defense counsel, in passing a law in the State of Minnesota, known as Amanda’s Law, requiring more advanced training and testing of drivers operating vans for school children.
